Right to Information (RTI)

Right to Information Act 2005 mandates timely response to citizen requests for government information. It is an initiative taken by Department of Personnel and Training, Ministry of Personnel, Public Grievances and Pensions to provide a– RTI Portal Gateway to the citizens for quick search of information on the details of first Appellate Authorities, PIOs etc. amongst others. Besides access to RTI related information / disclosures published on the web by various Public Authorities under the government of India as well as the State Governments.
Objectives

  • To ensure greater and more effective access to information under the control of public authorities.
  • To promote transparency and accountability in working of public institutions/organizations.

Statutory provisions made for right to information
Public Authority is under the obligation to provide information within 30 days from the date of request in normal cases or within 48 hours if information is a matter of life or liberty of a person.


What does RIGHT TO INFORMATION mean?
The right to Inspection of work, document records Taking notes, extracts, or certified copies of documents or records; Taking certified samples of material.


What does INFORMATION mean?
It means any material in any form including Records (RECORD means: Any document, manuscript and file Any microfilm, microfiche and facsimile copy of a document, any reproduction of image embodied in such microfilm any other material produced by a computer or any other device)

    LEVEL 1
    Individual Institution/ Organization / Department/ office/ Establishment will have Public Information officer PIO (designated)
    Assistant PIO (designated).PIO/APIO may seek the assistance of ANY OTHER OFFICER and this officer for the purpose of contravention of the provisions of this act shall be treated as a PIO/APIO.
    LEVEL 2
    Appellant Authority.At state Government Level will have The State Information Commission The State Chief Information Commissioner State Information Commissioners ( not exceeding 10)
    LEVEL 3: At Central Government Level will have The Central Information Commission The Chief Information Commissioner Central Information Commissioners ( < 10 )

    Making Request to PIO / APIO

    How to REQUEST?


    1. Any Indian citizen can obtain information about any public authority, including documents and records by applying to the Public Information Officer (PIO) of that Authority through electronic means in English or Hindi or official language
    2. An applicant has to pay an application fee of Rs. 10/- with the application
    3. The information will be made available on payment of cost as follow: -
    Fees for seeking information under RTI Act
                
  • Rs. 10/- to be accompanied with application.             
  • Additional fee representing cost of providing information:             
  • Rs. 2/- for each page created or copied.             
  • Rs. 50/- for providing information in floppy.
  •             
  • Rs. 100/-  for providing information in Diskette.             
  • Additional fee to be deposited by applicant within 15 day.
  • Inspection - No fee for inspection of record for first one hour be charged. For every 15 minutes in excess of first hour a fee of Rs. 10/- will be charged.

    Fee for inspection of record/document Rs. 20 per 30 minutes or fraction thereof


    No fees will be charged from people living below the Poverty Line

    Information with another Authority – transfer it immediately ( within 5 days, with intimation)

    1.         Payment is to be made by Treasury Challan/Bank draft/Indian Postal Order
    2.         BPL {Below Poverty Line} persons need not pay the application fee or any additional fee.
    3.         In case request for the information is refused or the request is not properly responded, an appeal can be filed with the Appellate Authority within 30 days. A second appeal lies with the State Information Commission within 90 days. There are no fees for appeals.
    4.         Information can be refused only on the following grounds:
    5.         Information , disclosure of which would prejudicially affect the sovereignty and integrity of India, the Security , strategic, scientific or economic interests of the States relation with forging State  or lead to incitement of an offence;
    6.         Information which has been expressly forbidden to be published by any court of law or tribunal  or the disclosure of which may constitute contempt of court;
    7.         Information, the disclosure of which would cause a branch of privilege   of Parliament  or the State legislature;
    8.        Information including commercial confidence, trade secrets or intellectual property, the disclosure of which would harm  the competitive position of a third party, unless the competent authority is satisfied that larger public interest warrants the disclosure of such information;  
    9.         Information available  to a person in his fiduciary relationship, unless the competent authority is satisfied that the larger public interest warrants the disclosure of such information;
    10.       Information received in confidence from foreign  Government;
    11.       Information the disclosure of which would enlarge the life  of physical safety of any person or identify the source of information or assistance given in confidence for law enforcement or security purposes;
    12.       Information which would impede the process of investigation or apprehension  precaution of offenders;
    13.       Cabinet papers including records of deliberations of the Council  of Ministers, Secretaries  and other officers; provided that the decisions of Council of Ministers, the reasons thereof, and the material on the basis of which the decisions were taken shall be made public after the decision has been taken, and the matter is complete, or over;
    Provided further that those matters which come under the exemptions specified in this section shall not be disclosed,   information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the Appellate Authority, as the case may be, is satisfied that the larger public interest justifies, the disclosure of such information; provided that the information which cannot be denied to the Parliament or a State Legislative shall not be denied to any person.
